Lawsuit challenges state's shift of road funds

OKLAHOMA CITY - The state is asking the Oklahoma Supreme Court to reject a lawsuit challenging a portion of the 2012 fiscal year budget.

Earlier this month, Oklahoma City attorney Jerry Fent filed a suit alleging that the transfer of $101 million from fuel taxes used for roads and bridges to other areas of government violated the state Constitution.

Fent alleges the Constitution prohibits the use of tax revenue levied for a specific purpose to be spent for unrelated functions.

Lawmakers adjourned in May after crafting a $6.5 billion state budget for next fiscal year. It included replenishing a portion of the transferred fuel tax funds with a $70 million bond issue for the Oklahoma Department of Transportation.
