OKLAHOMA CITY -- An Oklahoma City attorney has filed a lawsuit claiming a transportation funding bill approved by lawmakers last session violates a state constitutional requirement that bills deal only with one subject.
Attorney Jerry Fent filed the lawsuit Thursday with the Oklahoma Supreme Court. The suit names Gov. Mary Fallin, State Treasurer Ken Miller, Office of State Finance Director Preston Doerflinger and the state Department of Transportation.
The two-section bill Fent is challenging was a part of an overall budget agreement between the Legislature and Fallin.
The first section increases the amount of money allocated to a fund within the Department of Transportation. The second transfers $101 million from a transportation fund to help shore up a state budget shortfall.
Fent said he filed the lawsuit for the benefit of Oklahoma taxpayers.
